2. What data we process

Depending on how the shop is used, we process in particular the following categories of personal data:

  • technical usage data such as IP address, device and browser information, time of access and information on the use of the shop.

Complete card or account details are generally processed by Shopify or the payment service providers used at checkout. FemVital receives the information required for order processing, payment status and accounting.

3. Purposes of data processing

We process personal data in particular in order to:

  • process orders and payments and deliver products or provide digital content;
  • handle customer accounts, enquiries, returns and customer service;
  • comply with statutory retention, tax, accounting and documentation obligations;
  • operate the shop securely and reliably, detect misuse and fraud and fix errors;
  • evaluate and improve the shop and the shopping experience;
  • send newsletters or other direct marketing where consent has been given for this or where this is permitted by law. Marketing messages can be unsubscribed from at any time via the unsubscribe link or by email.

Where the General Data Protection Regulation (GDPR) is applicable, we base the processing, depending on the purpose, in particular on the performance of a contract, legal obligations, legitimate interests or consent.

4. Shopify and other service providers

Our shop is operated with Shopify. Shopify processes personal data to the extent necessary for hosting, shop functions, checkout, security, analytics and the provision of the Shopify services. Further information on data processing by Shopify is available in Shopify's privacy information.

In addition, we disclose personal data only to the extent necessary to categories of service providers that support us in performing the contract and operating the shop, in particular payment service providers, shipping and logistics service providers, IT/hosting service providers and, where applicable, email and marketing service providers. These recipients may process data only within the framework of the applicable data protection requirements.

5. Cookies and similar technologies

The Shopify shop uses cookies and similar technologies that are necessary for functions such as the shopping cart, checkout, security, language settings and technical provision. Where analytics, personalisation or marketing technologies are used beyond this and consent is required for them, they are used in accordance with the privacy or consent settings available in the shop.

6. Data transfers abroad

Shopify and other service providers may also process data outside Switzerland or the country of the data subject. For transfers to countries without a level of data protection recognised as adequate, appropriate safeguards such as recognised standard contractual clauses or other protective mechanisms provided for by law are used where required.

7. Retention

Personal data is retained only for as long as is necessary for the respective purposes. Order, contract and accounting data may be stored for longer due to statutory retention obligations. Data may also be retained to the extent necessary for the establishment, exercise or defence of legal claims.

8. Data security

We take appropriate technical and organisational measures to protect personal data. However, no electronic system can guarantee absolute security.

9. Rights of data subjects

Under the applicable data protection law, data subjects may in particular request information about their personal data as well as its rectification or erasure. Depending on the applicable law, further rights may exist, such as the right to restriction of processing, to object, to data portability or to withdraw consent. Statutory exceptions and retention obligations remain reserved.

Requests can be sent to info@femvital.ch. To prevent unauthorised disclosure, we may request suitable proof of identity.

10. Complaints

In Switzerland, data subjects may contact the Federal Data Protection and Information Commissioner (FDPIC) regarding data protection concerns. Where the GDPR or other foreign data protection law is applicable, there may additionally be a right to lodge a complaint with the competent data protection supervisory authority.
