General Terms and Conditions (GTC)

1. Provider

The online shop FemVital is operated by Renato Matarangolo, Mönchaltorferstrasse 6, 8625 Gossau, Switzerland. Contact: info@femvital.ch, +41 76 266 35 77.

2. Scope

These GTC apply to orders placed via femvital.ch. Mandatory statutory rights of consumers, in particular mandatory provisions of the country of delivery, remain reserved.

3. Products and information

FemVital offers, among other things, cosmetic, hair care and food supplement products as well as digital guides. Product information is prepared with reasonable care. Images may differ slightly from the actual product depending on the screen display.

Information on health, well-being, cosmetics or food supplements is provided for general information purposes and does not replace an individual medical diagnosis or treatment. The respective product, safety and dosage instructions must be observed when using the products.

4. Ordering and conclusion of contract

Before the order is submitted, entries in the shopping cart and checkout can be checked and corrected. By submitting the order with an obligation to pay, the customer makes a binding offer to purchase. Receipt of the order is confirmed electronically. An automated confirmation of receipt does not yet constitute acceptance, unless it expressly states otherwise. The contract is concluded at the latest upon shipping confirmation, dispatch of the goods or electronic provision of a digital product.

FemVital may refuse or cancel an order if a product is not available, if there is an obvious pricing or system error, or if there are reasonable grounds to suspect abusive or fraudulent orders. Payments already made for orders that are not fulfilled will be refunded.

5. Prices, taxes and payment

The prices displayed in the shop or checkout in Swiss francs (CHF) apply. The taxes, shipping costs and other costs applicable to the order are displayed, where required, before the order is completed. For deliveries outside Switzerland, additional customs duties, taxes or import charges may apply.

The payment methods currently available are displayed at checkout. Payments are processed via Shopify and the payment service providers offered in each case.

6. Shipping and delivery

Physical products are currently delivered within Switzerland and to the European countries available at checkout. Shipping costs are currently CHF 9.00 within Switzerland and CHF 12.00 for European delivery countries. Orders are generally processed and handed over to the shipping provider within 3 working days of receipt of the order or payment. The actual delivery time depends on the destination country and the shipping provider.

7. Digital products

Digital products such as e-books are provided electronically and do not incur any shipping costs. Unless otherwise stated, the buyer receives a non-transferable right of use for personal use. Unauthorised reproduction, passing on, making publicly available or commercial use is not permitted.

Where mandatory statutory information or withdrawal rights for digital content apply to consumers, these remain unaffected.

8. Returns and withdrawal

For suitable physical products, FemVital voluntarily grants a return option within 14 days of receipt, provided that the conditions stated there are met. In addition, mandatory statutory withdrawal rights may exist depending on the country of delivery. The conditions on the “Returns & Refunds” page and mandatory applicable law are decisive.

9. Defects and incorrect deliveries

Damaged, defective or incorrectly delivered goods should be reported as soon as possible after receipt. Mandatory statutory warranty rights and rights in respect of defects remain reserved. Where foreign consumer law is mandatorily applicable, its minimum claims and time limits apply.

10. Liability

FemVital is liable within the scope of the mandatory statutory provisions. A limitation of liability does not apply to the extent that it would be impermissible under the applicable law. Customers are responsible for using products in accordance with the respective instructions for use, safety instructions and dosage instructions.

11. Intellectual property

Texts, images, graphics, trademarks and digital content in the shop are, to the extent legally protected, the property of FemVital or the respective rights holders. Any use beyond the scope permitted by law or expressly granted requires the consent of the rights holders.

12. Data protection

Personal data is processed in accordance with the privacy policy published in the shop.

13. Applicable law and place of jurisdiction

To the extent permitted by law, Swiss law applies. Mandatory consumer protection provisions and mandatory places of jurisdiction at the customer's place of residence remain unaffected.
